The General Product Safety Regulation (GPSR) is a legislative framework established by the European Union to ensure that all consumer products sold within its member states are safe. It replaces the previous General Product Safety Directive (GPSD) and introduces updated requirements to address modern challenges like e-commerce, digitalization, and emerging technologies such as AI and IoT.
Key Features of GPSR:
- Scope: Applies to all consumer products marketed in the EU, including online sales and imported goods, but excludes items like food, medicinal products, and antiques.
- Mandatory Risk Assessments: Businesses must conduct pre-market safety assessments for potential hazards, including risks posed by new technologies.
- Traceability: Introduces stricter tracking mechanisms, including batch numbers and digital product passports, to enhance recall efficiency and market surveillance.
- E-commerce Accountability: Online marketplaces must ensure listed products comply with EU safety standards.
- Market Surveillance: Strengthens enforcement by empowering EU member states to monitor compliance actively and impose penalties for violations.
The GPSR came into effect on December 13, 2024, after an 18-month transition period following its adoption in May 2023. It aims to enhance consumer protection, improve product safety standards, and streamline recall processes across the EU market.
